All custom cake orders require a consultation either by phone or email. Orders must be finalized, and payment must be received a minimum of two weeks prior to pick up date and time.

Business Terms and Conditions
When placing an order with Sweet Eats Bakery (hereinafter “Me,” “My,” “I,” “We,” “Us,” “Our,” “Sweet Eats Bakery”),
you (hereinafter “You,” “Your,” “Customer,” “Client”) agree to the following Terms & Conditions:

Accepting our terms and conditions and payment establishes a legally binding agreement between you and Sweet
Eats Bakery.

Inquiries
We will send you a price quote within seventy-two hours of your request or consultation. However, your order will not
be finalized and confirmed until you have committed to our bakery by paying the invoice in full. Your event date is
secured, and your order is confirmed upon receipt of payment in full. Payment is required two weeks prior to pick up
date and time.

Orders
All custom orders must be placed with a two weeks advanced notice. Sometimes our bakery can accommodate an
order with shorter notice, so please get in touch with us to discuss your needs. A convenience fee will apply if Sweet
Eats Bakery accepts your order on short notice. Sweet Eats Bakery reserves the right to charge a rush fee for any
and all orders placed with less than a two weeks’ notice. We ask that you respect the schedule of our bakers and
cake decorators by placing orders two weeks before the needed pick-up date and time.

Artistry
When you agree to our business terms and conditions and pay for your order, you agree that any items ordered will
be reproduced as Sweet Eats Bakery’s interpretation of the item and will not be a replica. Sweet Eats Bakery
reserves the right to exercise artistic licensure to guarantee the structural, visual, and creative integrity of a cake or
dessert structure.

Every order is hand-made. Decorative finishes are done by hand and are subject to the artistic interpretation of our
expert cake decorators. You may provide us with a photograph for inspiration and duplication; however, we make no
claims for exact duplication of the work done by other cake decorators.

Custom cakes are a work of art; therefore, we will not copy the work produced elsewhere due to copyright or
trademark laws. The finished product(s) will be as similar as possible. We will make every attempt to provide the
design as requested, including matching colors.

If you are trying to order a highly decorated cake over the phone or email, you should provide us with a sketch or
picture (by email). Please note that we cannot read your mind and there are a lot of chances that the design of your
cake will be different of what you are expecting if not enough information is provided. We do not take responsibility if
the color of the decoration is a different shade that you had in mind.

Pick-Ups & No Call, No Show Orders
Please be on time to collect your order. You have a 15-minute window to pick up your order. If you cannot make your
scheduled collection time, please call to reschedule. If you do not call to reschedule your collection time and are late,
a late fee will be applicable. If you are early, you may have to wait until the agreed-upon time to collect your order.
Any order that is not picked up at the agreed-upon time without an attempt to reschedule is forfeited, and absolutely
no refund, future credit, or date change will be permitted under any circumstances.

Order(s) may be donated to charity or resold at the discretion of Sweet Eats Bakery.

Because of the nature of our business and our quality and freshness assurance, we will dispose of any items that
have not been picked up or delivered within 48 hours after the specified collection time has passed.

Quality and Storage
Sweet Eats Bakery is not responsible for any damage done to the product after it has been picked up by the
customer. Sweet Eats Bakery is not responsible for any damage the product may suffer due to the environmental
conditions in which the cake is stored or displayed (location, temperature, weather, etc). An extended period without
refrigeration will deteriorate the cake as well as the decoration.

Your order will be baked as close to your delivery/collection day as possible to ensure quality and freshness. We
suggest that cakes should be eaten as close to the collection date as possible. Sweet Eats Bakery advises that all
food must be consumed within 6 days of the first serving. Food must be properly stored in an airtight container and/
or refrigerated if necessary. Any food consumed after 6 days or later is at the client’s discretion and becomes their
responsibility.

Changes in Orders
Sweet Eats Bakery understands that plans change and we will gladly assist you in making changes to your order
date and time whenever possible.

We accept changes (flavors, fillings and some designs) for your order with 7 days’ notice before pick up date. This
does not apply for custom cakes with intricate designs or last minute orders placed with less than 48 hours notice.
This is because for some designs our team may need more than 10 days in advance to start working on the
decoration of your cake.

All changes must be handled and confirmed directly with a staff member of Sweet Eats Bakery.

We always put in our best efforts to make sure that your order is decorated to the specification on your written order
form. Upon pick-up of your cake, adjustments can usually be made for an additional charge if it was not stated on
your original order. If for some reason something is not decorated correctly as stated on your order, we will do our
best to make necessary changes right away.

Order Cancellations

We accept cancellations up to 7 days before the delivery or pickup date. However, this does not apply for custom
cakes with intricate designs or last-minute orders placed with less than 48 hours’ notice. Sweet Eats Bakery reserves
the right to charge a cancellation fee if insufficient time is given, as stated above, due to costs incurred in the
purchase, preparation and prioritization of the order.

Charges for cancellations will be as follows:

•  15 days or more prior to pick-up or delivery date, 75% of your order total will be returned as store credit,
  valid for one year starting from the date of cancellation. If there is any balance pending this will be due
  immediately.
• 7 days or more prior to pick up or delivery date, 50% of the entire order will be charged. If there is any
  balance pending this will be due immediately.
• less than 7 days prior to pick-up or delivery date, no refunds will be given, and the total amount of the order
  will be due.

It is entirely up to Sweet Eats Bakery’s discretion to change or otherwise offer any other options to the customer.

Refund Policy

We take pride in all our products. If you are unhappy with your order and/or purchase when picking up or within 24
hours of pick-up, working days, immediately notify us of your concern and return your complete order to us.
No refunds are given on any orders unless the complete order is returned. NO CASH refunds, only store credit.
Sweet Eats Bakery is not responsible for orders once they leave our premises. We are not responsible for any
damage occurring to the cake during transport, set-up or any time thereafter. You will be given instructions on how to
carry, transport, and store your cake upon pick up. If you do not receive these instructions, please ask our associate.
Keep in mind that cakes are very fragile and damages can happen if not handled properly, such as cracks, smudges,
melted frosting, etc.

We only give refunds in accordance with the refund policies stated below.

Full refunds requested after the cake has been accepted and picked up will not be honored. You may qualify for a
partial refund in the form of a store credit if the product is brought back and the quality of the cake is determined to
not meet our standards. Cakes must be brought back to us within a timely manner, preferably with 24 hours of pick
up – please call or email us promptly to let us know of the issue. Quality determination is solely at the discretion of
Sweet Eats Bakery. Please understand that we cannot issue refunds for cakes that have already been eaten. *Store
credit is based on how quickly the cake is returned, how much has been consumed, and what we determine the
quality to be. Store credits of any kind will not be issued to customers who do not contact us within 48 hours of pick
up.

Special orders that are not picked up will NOT be refunded.

The following scenario is the only instance when we may provide a partial refund in store credit:
If you come to our store for pick up or if upon delivery the cake does not meet your expectations (i.e. designer error),
we will give you a refund (minus 25% handling/cancellation fee). This refund will be given as a store credit (no
cash/money refunds will be given). NOTE: If we give you a refund, you CANNOT keep the cake. You can only get the
refund if you refuse to “accept” the cake. We will NOT negotiate a partial refund if you keep the cake. This is a “take
it, or leave it” policy. We are not responsible for any expense you may incur for replacing our cake.

***We do not give refunds under any other circumstances.

It is entirely up to Sweet Eats Bakery’s discretion to change or otherwise offer any other options to the customer.

Non-Payments
Sweet Eats Bakery will only complete an order if paid for in full. If the invoice is not paid in full before the due date,
you forfeit your order, and absolutely no refund, future credit, or date change will be permitted under any
circumstances.

Sweet Eats Bakery does not accept responsibility for any loss, howsoever caused for non-payment. Therefore, if the
total amount of an order is not received by the due date, we will mark the order as canceled. The cancellation policy,
therefore, applies in all cases. If you attempt to make payment after the due date, Sweet Eats Bakery reserves the
right to refuse your payment. In addition, if Sweet Eats Bakery chooses to resume work on the order, you will be
charged a late fee of 25% of the total cost of the order (excluding taxes). Payment is due at the time of confirmation.

Allergies
We cannot guarantee that any item is allergen-free because we use shared equipment to store, prepare and serve all
items. Please be aware that while your order may not be made with nuts or a nut product, it will have been prepared
in a kitchen where nut products may be used in other cakes and fillings. We cannot guarantee that your product(s)
will be free from all nut traces. All products may contain, or come into contact with, soy, wheat, dairy, nuts, natural
dyes, artificial dyes, artificial flavorings, sugar, artificial sweeteners, artificial color, and other allergens not listed. It is
your responsibility to inform your guests of this allergy information. Sweet Eats Bakery will not be held liable for any
allergic reaction resulting from the consumption of any products.

Photography/ Media
Sweet Eats Bakery reserves the right to use pictures of any cake created by Sweet Eats Bakery in any way it deems
fit, including, but not limited to, postings on social media and advertisement.

Liability
Sweet Eats Bakery is not responsible for bodily injury or consequential damage which may result from services.

By placing an order with Sweet Eats Bakery, you agree to these Terms and Conditions in their entirety.
